Terms of Service

1. About these terms

These terms apply when you use Recipe Costing at recipecosting.cc. The service is run by Hola Coco Ltd (“we”, “us”), a private limited company registered in the United Kingdom with company number 10842330. Our registered office is 245, John Spibey Associates, Bury New Road, Manchester, M45 8QP, United Kingdom. You can contact us at info@recipecosting.cc.

By using the service you agree to these terms. Our Privacy Policy explains how we use your information. Some sections treat you differently depending on whether you are a consumer (acting mainly outside a trade, business or profession) or a business customer. Nothing in these terms removes rights that the law gives you and that cannot be excluded.

2. Eligibility and your account

• You must be 18 or over to create an account or subscribe.
• Signing in for the first time creates a free account. Each account is for one person.
• We sign you in with links sent to your email address, so keep that email account secure and do not share sign-in links. Tell us straight away if you think someone else has used your account.
• If you use the service for a business, you confirm you are allowed to accept these terms for it.

3. The free calculator

You can use the recipe cost calculator without an account or payment. Your work stays in your own browser and is treated as expired after 7 days. It can be lost sooner if you clear your browser data or use another device. We may change or limit the free calculator at any time.

4. Temporary drafts

If you save a calculation and sign in, it becomes a temporary draft. Temporary drafts are kept for 7 days and then deleted automatically, and we cannot recover them afterwards. A draft is not a saved recipe. To keep it, turn it into a saved recipe with Pro before it expires.

5. Pro subscriptions, billing and renewal

Pro costs £12 a month, charged in pounds sterling through our payment provider, Stripe. Pro includes saved recipes, a shared ingredient library, dated price changes, the change-impact view and dated costing-sheet PDFs. It starts once Stripe confirms your first payment.

• Renewal. Your subscription renews automatically every month, and we will take payment each month using your saved payment method until you cancel.
• Failed payments. Stripe may retry a failed payment. If payment still cannot be taken, your subscription can end and Pro will stop.
• Tax. Hola Coco Ltd is not currently VAT registered, so we do not add UK VAT. If that changes, or tax applies where you live, we will show it before you pay.
• Price changes. We will email you at least 30 days before a price change affects you. You can cancel before it takes effect. If you do not, the new price applies from your next renewal.

6. Cancellation and refunds

Cancelling. You can cancel at any time from your account page using Manage billing. Pro then continues until the end of the month you have paid for, and no further payments are taken.

14-day cancellation and refunds. You can cancel within 14 days of first subscribing and ask for a refund. When you subscribe, you ask us to start Pro straight away, so we will refund what you paid minus a pro-rata amount for the days before you cancelled. Consumers have a legal right to cancel in this period, and we offer the same refund to business customers.

To do this, email info@recipecosting.cc from your account email address, or send us any other clear statement, within the 14 days. You can write: “I cancel my Recipe Costing subscription”, with your name, the date you subscribed and today’s date. You can use the wording but do not have to. We will end your subscription and refund you within 14 days to your original payment method. Pro will stop when the subscription ends.

After 14 days. We do not refund part-months, including if you stop using the service during a month you have paid for. This does not affect your legal rights, for example if the service is faulty.

7. When a subscription ends

Your account becomes a free account. Your saved recipes, ingredients, price history and costing sheets stay in your account. You can still view them, download existing costing sheets and export your data. You cannot create or change them, create new costing sheets or use the change-impact view unless you subscribe again. Your work is kept until your account is deleted, including under the inactive account rule.

8. Your recipes and data

You own the recipes, ingredients, prices and other content you enter. You give us permission to store, copy, process and display that content only so far as we need to run the service for you. We do not claim ownership of it and do not publish it.

You are responsible for what you enter, and you must have the right to use it. Please keep your own copies of anything important, using the export on your account page.

9. Acceptable use

You must not:

• break the law, or infringe anyone else’s rights, when using the service;
• try to access another person’s account or data, or get around Pro or security controls;
• attack, overload, probe or disrupt the service, or introduce malicious code;
• scrape, copy or resell the service, or use it to build a competing product;
• use automated tools in a way that puts an unreasonable load on the service.

10. Accuracy of costing results

Recipe Costing results are estimates based on the information you provide. They are not guaranteed, and they are not business or financial advice. The service does arithmetic on the figures you enter, so results are only as good as those figures. Please check them before relying on them.

• Unless you build them into your figures, results do not include tax, overheads, waste, failed bakes or unsold stock.
• The service does not check that your prices or quantities are correct or current. Saved recipes use the ingredient prices you have entered.
• Weight and volume are not converted into each other, and there is no currency conversion.
• Displayed figures are rounded, so they can differ slightly from a sum done by hand.
• A costing sheet records the figures on the day it was made, and it does not update when prices change.

11. Tax, pricing and business decisions

You decide what to charge and how to run your business. We do not provide tax, accounting, legal or financial advice, and we do not promise any level of sales, margin or profit. A margin in the service is not the same as your business profit. Take advice from a qualified professional where you need it, including on any tax you owe or must charge.

12. Service availability and changes

We aim to keep the service available, but we do not promise it will be uninterrupted or free of errors. It may be unavailable because of maintenance, updates, or problems with our suppliers. We may improve or change the service. If a change significantly reduces what you pay for, we will tell you, and you can cancel. If we stop offering Pro, we will give you reasonable notice, refund any payment for time after it stops, and give you the chance to export your data.

13. Intellectual property

We or our licensors own the service, including its software, design, text and branding, but not your content. We give you a personal, non-transferable right to use the service under these terms. You keep the right to use your own costing sheets and exports in your business.

14. Suspension and termination

We may suspend or close an account if there is a serious or repeated breach of these terms, if we must do so by law, or to protect the service or other users. Where reasonable, we will warn you first and give you a chance to put things right and to export your data. If we close your account without you being in breach, we will refund any payment for time after closure.

You can delete your account at any time on your account page. If you have Pro, cancel first. You can then delete straight away, and any paid time left is lost. Deletion is permanent. If a free account has not been used for 23 months, we will email a warning and delete it 30 days later if it is still unused.

15. Our liability

For everyone. Nothing in these terms limits our liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot legally be limited.

Consumers. If you are a consumer, we must provide the service with reasonable care and skill and as described. We are responsible for foreseeable loss caused by our breach of these terms or our negligence. We are not responsible for loss that was not foreseeable, or for loss of business or profits if you use the service for a trade or business.

Business customers. The service is otherwise provided without any warranties or terms that can legally be excluded. We are not liable for loss of profit, revenue, business or goodwill, for pricing decisions, or for any indirect or consequential loss. Our total liability in each 12-month period is limited to the greater of £100 and the amount you paid us in that period.

16. Changes to these terms

We may update these terms when the service or the law changes, and we will show the new effective date at the top. If a change materially affects you, we will tell you by email or on the site at least 30 days beforehand, unless it must happen sooner by law. If you do not agree, you can cancel before it takes effect. If you keep using the service afterwards, the new terms apply.

17. Governing law and disputes

Please contact us first at info@recipecosting.cc so we can try to sort out any problem. We do not currently use an alternative dispute resolution scheme.

These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you are a consumer living elsewhere, you keep the mandatory protections of the country where you live, and you may be able to bring a claim in the courts there.

18. General

Only you and we have rights under these terms. If a court finds part of these terms invalid, the rest still applies. We may transfer these terms to a buyer of the business, and this will not reduce your rights. If we do not enforce a term straight away, we can still do so later.
